GigaQualify Privacy Policy

GigaQualify is operated by Giga Techspace Inc., 111 Congress Ave, Suite 500, Austin, TX 78701, USA ("we"). Contact us about privacy, consent or legal matters at legal@gigatechspace.com.
This policy covers GigaQualify candidates, recruitment customers and business accounts. It does not cover unrelated CAD project delivery by Giga Techspace Inc. or general marketing-website tracking. For GigaQualify information, this policy prevails over inconsistent statements in a general privacy policy of Giga Techspace Inc.
Who is responsible
The hiring organization named on the interview page decides why to conduct the recruitment and how to use its results. We process candidate records on its behalf to provide GigaQualify. The employer is responsible for its own recruitment practices, privacy notices and copies of recruitment records. Contact it using the details on the interview page for information about those activities.
Giga Techspace Inc. separately determines the purposes of business-account administration, essential service security, requests addressed to us and permitted business communications. The employer's responsibilities do not remove our obligations for information we process.
Candidate information and its use
We receive your name, email address, role and invitation details from you or the employer. We use them to arrange the interview and verify access to your email. Email verification does not establish your identity, employment history or professional qualifications.
Your CV may be uploaded by you or provided by the employer through its recruiting system, also called an applicant tracking system or ATS. The employer may provide your CV and contact information before you open the interview link. We also receive identifiers needed to connect the correct application, employer and role. We hold these records on the employer's instructions to arrange the recruitment and manage its records. The interview page explains which CV source will be used. Later interview consent does not replace the legal basis and information required for an earlier transfer from the employer.
After you give the interview consents, AI uses your CV to prepare questions about your work. During the interview, we process your voice, audio recording, transcript and answers. AI may ask follow-up questions and assesses answer content against the role criteria shown before you agree. The assessment includes criterion scores, supporting excerpts and a summary. We keep the questions and criteria used, assessment records, consent and terms-acceptance evidence, and interview status to deliver and explain the service and meet recordkeeping obligations.
We use this information to conduct the interview, provide results to the employer, handle support and correction requests, secure the service, and manage access, export, retention and deletion. We do not use candidate information for marketing by Giga Techspace Inc., for a talent pool, or for profiles combined across employers.
Please do not include identification numbers, medical or family details, or confidential information from another employer unless specifically necessary for a lawful request. Such information is not requested for scoring. If you mention it in an answer, it may remain in the original recording or transcript even though it should not be used in the assessment.
AI, recording and hiring decisions
GigaQualify uses speech recognition and language models to conduct the conversation, transcribe speech and assess role-related answers. We do not score accent, vocal tone, emotions or inferred personality, or create voiceprints to identify candidates.
The employer receives an automatically generated assessment. Giga Techspace Inc. does not routinely review each report before delivery. Transcription and assessment can contain errors. The employer is responsible for human review of relevant evidence and each recruitment decision. GigaQualify does not automatically reject or advance you. Contact the employer to report an error or request human review; we can help route a request.
We do not use candidate content to train or fine-tune AI models. We use AI services with training on that content disabled and do not authorize providers to train on it. This does not mean that providers retain no information to operate or protect their services.
Who receives information
The employer's authorized recruitment staff receive your CV, recording, transcript and assessment, as applicable to the interview. If the employer uses an ATS integration, we process the records needed for that integration on its instructions. The employer remains responsible for its own ATS and downloaded copies.
Authorized development and support personnel of Giga Techspace Inc., including our team in the European Union, may access records as needed to operate and troubleshoot the service, handle requests, maintain security or comply with law. Providers process information needed for hosting, storage, AI, voice, email delivery and related service functions, as described below. Access is limited to the relevant service purpose.
We may disclose information when legally required, to address fraud or security incidents, to establish or defend legal rights, or in a business transfer subject to continuing data-protection obligations. A business transfer does not itself authorize a new use of candidate information.
We do not sell personal information or share it for cross-context behavioral advertising.
International processing
Giga Techspace Inc. is based in the United States. We store CV files and the application database with AWS in US East (Ohio), United States, and have authorized development and support access from the European Union. AI and voice services have their own processing arrangements, so the location of our AWS storage does not determine every processing location. Information may be stored or processed outside the country where you live or apply for work. The applicable processing locations are provided in the interview information before you agree; they include relevant hosting, AI processing and support access.
A provider's registered office is not necessarily the location where it processes data. Information processed abroad may be subject to local laws and lawful government-access requests. We use contractual protections and legally required international-transfer safeguards. Interview consent is not a replacement for a safeguard required by law. Service providers and retention
The services used for GigaQualify include:

These services may use authorized downstream providers. For the voice conversation, ElevenLabs supplies the conversation models as part of its service. Microsoft supplies the separate Azure AI processing described above. Contact us for the current provider and processing information relevant to your interview or business account.
Recruitment records. We agree a retention schedule with the employer before collecting or importing candidate records for a recruitment. It identifies the record categories, the retention period and when that period starts. We show the relevant periods for audio and other interview records before you give the interview consents.
There is no single retention period for every recruitment in the United States and Canada. We determine retention using the recruitment purpose, applicable federal, state and provincial recordkeeping requirements, the records used in decisions, candidates' access and challenge rights, and any documented preservation obligation. Audio is included in this review. The schedule also covers imported CVs, declined interviews and interviews that never start, so those records do not wait indefinitely for a completed interview.
When the applicable purpose and retention requirements end, we delete or return the records under the agreed schedule. A legal obligation, pending rights request, investigation or documented legal claim may require particular records to be kept longer. We limit preserved records to that purpose and review whether the need continues. The employer's own copies follow its retention responsibilities; deleting our copy does not automatically delete its copies.
Provider copies. Providers may retain conversation history, submitted content, service metadata or security records under the applicable service configuration and lawful requirements. We address copies processed on our behalf through provider settings, deletion requests and contractual obligations as part of the recruitment retention schedule. Training opt-out is separate from storage and deletion settings. We do not represent every AI request as having zero retention or every deletion as immediately removing all provider-held records.
ElevenLabs conversation history. ElevenLabs' default retention period for conversation transcripts and saved audio is two years. We can configure these periods separately in days to match the recruitment schedule shown before you consent. This setting applies to ElevenLabs' conversation history; CVs, our application records and the employer's own copies follow their respective retention arrangements described above.
Logs and security. We do not put candidate names, email addresses, CV contents, audio, answers or reports into our application diagnostic logs. Consent records and recruitment records are kept separately from those logs. Our service and its infrastructure still process the technical information needed for connections, authentication and security; provider-side security or abuse-monitoring records are governed by the applicable provider arrangements. Relevant incident records may need to be preserved to investigate or meet legal obligations.
Your choices and privacy requests
Taking part in the AI interview is voluntary. You can decline, stop, or ask the employer for another format or an accommodation using its contact details on the interview page. You do not need to provide medical details to Giga Techspace Inc. to request another format. The employer may see that the interview was not completed or that you requested an alternative. GigaQualify does not treat this as a failed assessment.
To withdraw interview consent or make a privacy request, contact legal@gigatechspace.com. We stop further processing that depends on withdrawn consent, including pending AI assessment. Withdrawal does not undo processing already lawfully completed or override a separate lawful retention obligation. Stopping an interview does not automatically delete records already collected.
Depending on applicable law, you may request access, a copy, correction or deletion of personal information; withdraw consent where it is the basis for processing; object to or restrict certain uses; request review of an automated assessment; or complain to a privacy authority. Send a request to the employer or to us. We coordinate with the employer for records processed on its behalf and address our own processing directly.
We may verify your identity proportionately without requiring a new account. If you cannot access your original email, contact us for another verification method. Authorized representatives may act where permitted. We respond within the applicable legal deadline, explain any lawful refusal or retention exception, and provide relevant appeal or complaint options. We do not retaliate for exercising privacy rights.
Business-account information
We handle business users' names, work contact details, organizations, verification and account records, service usage, terms acceptances and support correspondence. GigaQualify may share an account with other services of Giga Techspace Inc. We use this information to provide and secure the service, administer the relationship, provide support and understand business interest in the services of Giga Techspace Inc. Candidate identities and interview records are excluded from that sales purpose.
We send necessary verification, account and service messages. Promotional email about GigaQualify and the CAD production services of Giga Techspace Inc. is sent when you separately opt in or expressly request contact. You can unsubscribe or contact us to withdraw marketing consent without losing service access. qualify@gigatechspace.com is the marketing contact; legal@gigatechspace.com handles privacy and legal requests. We keep a limited suppression record to honor opt-outs.
We keep business-account information while needed for an active relationship, including another service using the same account, and afterwards only for applicable legal, security, request-handling or claims purposes. Support records are kept while needed to resolve and document the issue. We review acceptance, consent, security and closed-account records when their purpose ends and delete them when no justified need remains.
Where EU or UK data-protection law applies to our processing for our own purposes, we rely on legitimate interests in operating and securing the service and administering customer relationships, subject to individuals' rights; legal obligations where applicable; and consent for optional marketing. The employer identifies the legal basis for its recruitment processing and provides its own required information. Consent to the recorded AI interview is not the legal basis for every security or recordkeeping activity.
Cookies, security and changes
GigaQualify uses essential cookies or similar storage for sign-in, session continuity and security. We do not use advertising pixels or cross-site behavioral advertising in the candidate interview flow. Optional tracking requires the applicable notice and choice before activation. The general marketing website of Giga Techspace Inc. has its own cookie information; visiting that website is separate from participating in an interview.
We use measures appropriate to the information and risks to control access and protect the service. No system guarantees absolute security. We may update this policy and will communicate material changes as appropriate. A policy update alone does not authorize a new use of information already collected.
